THIS PRIVACY POLICY APPLIES TO YOUR ACCESS AND USE OF THE CAITER SERVICE, INCLUDING USE OF OUR WEBSITES, WEB APPLICATION, AND OTHER ONLINE PROGRAMS (COLLECTIVELY, THE "CAITER APPLICATION"). BY ACCESSING OR USING ANY PART OF THE CAITER APPLICATION, YOU ARE AGREEING THAT YOU HAVE READ AND AGREE TO BE BOUND BY THIS PRIVACY POLICY, INCLUDING ANY ADDENDUMS. IF YOU DISAGREE WITH ANY PART OF THIS PRIVACY POLICY, THEN PLEASE DO NOT USE ANY OF THE CAITER APPLICATION.
We want you to enjoy every visit to caiter.co and every experience with the Caiter Application. We do collect information about you and we may share that information with third parties in certain circumstances, so please read on for more details about how we use personal information we collect about you when you use the Caiter Application.
Our online privacy practices are governed by applicable laws in the jurisdictions where we operate, which may differ from privacy laws in your state or home country. By submitting your personal information to us or our agents through the use of the Caiter Application, you consent to the transfer of your personal information to any country and its use and disclosure in accordance with applicable law and with this Privacy Policy.
We may change our Privacy Policy, so please check this page from time to time. Your continued use of the Caiter Application after we publish changes indicates your acceptance of any changed terms.
This privacy policy has been compiled to better serve those who are concerned with how their "Personally Identifiable Information" (PII) is being used online. PII, as described in US privacy law, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. PII or "Personal Information" includes, but is not limited to, information such as your:
Please read this privacy policy carefully to get a clear understanding of how we collect, use, protect, or otherwise handle your Personally Identifiable Information in accordance with our website and application.
We collect information from you when you register for an account, request a demo, subscribe to a newsletter, respond to a survey, fill out a contact form, submit a support request, provide feedback on our products or services, or enter information on our site or in the Caiter Application.
We also collect information automatically when you use the Caiter Application, including through cookies and similar technologies.
We may use the Personal Information we collect from you when you register, subscribe, respond to a survey or marketing communication, browse the website, use the Caiter Application, or use certain other site features in the following ways:
If you use Caiter to serve your own customers — for example, by sending proposals, quotes, order forms, or client-facing mini-sites — you may collect end-customer data through the Caiter Application. In that case, you act as the data controller for your customers' data, and Caiter processes that data on your behalf as a processor/service provider in accordance with your instructions and applicable law.
Your privacy is very important to us. We generally will not disclose your Personal Information to anyone outside of Caiter, except in the following circumstances.
We may disclose your Personal Information to third-party service providers to provide us with services such as website hosting, cloud infrastructure, professional services, including information technology services and related payment processing, customer service, e-mail delivery, analytics, auditing, and other similar services.
We may disclose your Personal Information to third parties in order to perform services you request or functions you initiate. For example, when you publish or share a proposal, quote, or client-facing page through the Caiter Application, information you include in that content may be visible to the recipients you choose. When you post information in a public or shareable context, it may become public information and will not be treated as Personal Information under this Privacy Policy insofar as it is visible to others by your action.
We may disclose your information to a third party in connection with a corporate reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock, including in connection with any bankruptcy or similar proceedings.
In addition, we may use or disclose your Personal Information as we deem necessary or appropriate: (1) under applicable law, including laws outside your country of residence; (2) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (3) to comply with subpoenas and other legal processes; (4) to pursue available remedies or limit damages we may sustain; (5) to protect our operations; (6) to protect the rights, privacy, safety, or property of Caiter, you, and others; and (7) to enforce our terms and conditions.
Similarly, we generally use non-personal information for any purpose not prohibited by law. In particular, we may collect, compile, store, publish, promote, report, or otherwise disclose or use any and all non-personal information, provided that such information does not personally identify you. The non-personal information we collect generally will not personally identify you or be correlated to you individually for external purposes.
Where we combine non-personal information with Personal Information in a way that can identify you or be used to identify you personally, we will treat that information as Personal Information, subject to the provisions of this Privacy Policy.
We implement technical and organizational measures designed to protect your Personal Information, including access controls, encryption in transit where appropriate, and restrictions on who may access systems containing Personal Information.
We implement a variety of security measures when a user registers, enters, submits, or accesses their information to maintain the safety of your Personal Information.
Payment transactions are processed through third-party payment providers and are not stored on our servers except as necessary to manage your subscription and billing records.
Unfortunately, no system or online transmission of data can be guaranteed to be 100% secure, and you should always take appropriate security measures to protect your Personal Information, including ensuring that you have up-to-date antivirus software. If you believe that your Caiter account or any information you provided to us is no longer secure, please notify us immediately through the Contact Us information provided below.
You can visit the account section of the Caiter Application to manage and correct factual inaccuracies in the information we have on file about you, subject to the functionality available in your account.
If we choose to send to you, or you have elected to receive, bulletins, updates, or other marketing-related materials, we will provide you with the ability to decline — or "opt out" — of receiving such communications. Instructions for opting out will be provided if and when we determine to send you such a communication. For example, if you no longer wish to receive email messages from us, you can opt out of emails by either (i) following the "unsubscribe" instructions located near the bottom of each email message, or (ii) contacting us as provided in Contact Us below. Please understand that we may still communicate with you in connection with administrative notices concerning any transactions, operation of the platform, and legal notices.
We use cookies and similar technologies to:
We may also use trusted third-party services that track this information on our behalf, such as Google Analytics and, in the future, advertising platforms such as Google Ads.
You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies through your browser settings. Because each browser is a little different, look at your browser's Help menu to learn the correct way to modify your cookies.
If you turn cookies off, some of the features of the website or application may not function properly, and this could affect your user experience.
We do not currently use third-party behavioral tracking for advertising purposes on the Caiter Application, such as remarketing or retargeting pixels that follow you across other websites.
We may use such technologies in the future to measure and improve our marketing campaigns. If we do, we will update this Privacy Policy and, where required by law, obtain your consent before placing non-essential advertising cookies or similar technologies.
We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information unless we provide users with advance notice where required. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or serving our users, so long as those parties agree to keep this information confidential. We may also release information when its release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property, or safety.
However, non-personally identifiable visitor information may be used in aggregated form for analytics, product improvement, marketing, advertising, or other uses.
Our website or application may contain links to third-party websites, services, or integrations. When you access Caiter through any social networking or third-party sites, applications, or services, please remember that you are bound by the privacy policy of the social network or third-party site, application, or service, and we do not control and are not responsible for the privacy practices of such sites. You should consult the privacy policy of such sites to determine the information practices of those sites.
Google's advertising and analytics requirements are described in Google's Advertising Principles.
We use Google Analytics on our website and application to understand how visitors and users interact with Caiter. Google Analytics uses cookies and similar technologies to collect and analyze information about use of the Service and to report on activities and trends.
We may also use Google advertising services in the future, such as Google Ads remarketing. Those services may use cookies or similar technologies to show Caiter-related ads on other sites based on your prior visits to our website. Users may opt out of personalized Google advertising by visiting Google Ad Settings.
You can learn more about how Google uses data when you use our site or app by visiting Google's Privacy & Terms page. You may opt out of Google Analytics by using the Google Analytics Opt-out Browser Add-on or by adjusting your browser or device settings where available. You may also opt out of interest-based advertising more broadly by visiting the Network Advertising Initiative opt-out page.
The Caiter Application may support third-party integrations. Whenever you authorize those integrations, you will be given an option of what data will be shared, and your use of the integration is subject to the third party's privacy policy as well as this Privacy Policy. For example, if you connect an external calendar, payment, or communication service, you may be agreeing to share with that provider information about your orders, clients, payments, or other data you selected.
We provide the following additional rights with respect to our collection, use, disclosure, or sale (if applicable) of your Personal Information where required by applicable laws (such as for California residents) or as otherwise appropriate in our reasonable discretion:
You can submit any of these requests by emailing us at support@caiter.co. You may authorize another person (your "Agent") to submit a request on your behalf the same way. Shortly after you (or your Agent) submit a request, we will contact you (usually via email) with instructions on how to verify the submitted request before we fulfill it. Please be advised that these requests are unrelated to an opt-out of marketing communications, which can be done as provided above in How To Manage Your Account Information; Opting Out. Please note that in addition to submitting privacy requests as described here, you can opt out of our use of third-party advertising technology on your device by configuring settings on your browser and/or device, including through the Google and NAI opt-out links described above.
We will fulfill these requests in our reasonable discretion and as may be required by applicable law.
California law requires certain businesses to respond to requests from California users who ask about business practices related to disclosing Personal Information to third parties for their own direct marketing purposes. The California "Shine the Light" law further requires us to allow California residents to opt out of certain disclosures of Personal Information to third parties for their own direct marketing purposes.
Some browsers offer a Do Not Track (DNT) signal. There is no uniform industry standard for how websites should respond to DNT signals. We do not currently respond to DNT signals for analytics purposes. If we begin using advertising or retargeting technologies, we will describe our DNT practices in an updated version of this Privacy Policy.
We do not provide a financial incentive or a price or service difference to customers in exchange for the retention or sale of their Personal Information. We may send promotions and other offers to those individuals subscribing to our marketing communications and, unless an individual has opted out of such communications, the individual will continue to receive such communications irrespective of whether a disclosure, deletion, or "Do Not Sell" request has been submitted. We do not offer financial incentives to deter customers from making such requests.
We will not discriminate against any customer for exercising their privacy rights.
If you have any questions about our privacy practices, including in connection with the California Consumer Privacy Act, please contact us as directed in Contact Us below.
For Nevada residents, please note that we do not sell personal information as defined by Nevada law. You can submit a request to us as set out in Contact Us below.
Caiter recognizes the importance of protecting the privacy of children. We will not knowingly collect any personally identifiable information from children under the age of thirteen (13). When a user discloses Personal Information on the Caiter Application, the user is representing to us that he or she is at least thirteen (13) years of age.
When it comes to the collection of Personal Information from children under the age of 13, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, the United States' consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.
We do not specifically market to children under the age of 13. If a child under the age of thirteen (13) has provided us with personally identifiable information through the Caiter Application, we ask that a parent or guardian email us at support@caiter.co, and we will delete the child's information from our records.
The Fair Information Practices Principles set forth certain privacy concepts in the United States, and the concepts in the Fair Information Practice Principles play a significant role in the development of data protection laws around the globe.
To be in line with Fair Information Practices, we will take the following responsive action should a data breach occur:
We also support the Individual Redress Principle, which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.
If you are located in the European Economic Area or the United Kingdom, you may have additional rights under the General Data Protection Regulation and applicable local law, including the right to access, correct, delete, restrict, or port your data, and to object to certain processing.
Where applicable, we rely on the following legal bases:
Data may be processed in countries outside your own. Where required, we use appropriate safeguards for international transfers.
